The Terms and Conditions of this Patient Contract apply to all services and procedures carried out by Dr Anna Fogli (MD, MS). These terms and conditions, dated 15 May 2020, apply to your access to and use of the www.drannafogli.com website. By continuing to use this website, you are agreeing to comply with and be bound by these terms and conditions. Moreover, you are agreeing that you are responsible for compliance with all related laws and regulations. If you do not agree with any of these terms, you are forbidden to use or access this site. All the contents comprised in this website are protected by copyright and trademark law.
Dr Anna Fogli reserves the right to change these terms and conditions at any time without notice from time to time. Amendments will be effective at the time the amended terms and conditions are posted on this website. By continuing to use this website you are responsible for ensuring you are aware of the current terms and conditions. These Terms and Conditions take precedence over the contents of any literature or written material provided by Dr Anna Fogli to the Patient where such contents conflict with these Terms & Conditions.
DEFINITIONS
“Dr Anna” means Doctor Anna Fogli Malezhik, MD, MS.
“Patient Information” refers to the information supplied by Dr Anna Fogli to her patients both in brochure and letter form.
“Procedure” refers to the treatment to be carried out by Dr Anna Fogli
“Patient” means any person who has entered into a contract for a Procedure.
“Cost” is Total Treatment Price as detailed on the quotation.
“Consultation” is a pre-operative meeting between Patient and Dr Anna Fogli at which the Patient’s suitability for the Procedure is considered.
OBLIGATIONS AND WARRANTIES
Dr Anna Fogli is registered with the General Medical Council and Ordine dei Medici Chirurghi ed Odontoiatri della Provincia di Torino (Medical, Surgical and Dentistry Council of Torino, Italy)and is obliged to maintain full Private Practice Medical Indemnity Insurance.
PATIENT’S OBLIGATIONS
You agree to have read and understood the Patient Information and fully understood the range of possible outcomes of the proposed procedure. However, the decision to carry out the procedure shall be at the discretion of Dr Anna Fogli.
The Patient will be required to sign a Medical Consent Form, that may be withdrawn at any point or terminated.
The Patient agrees to provide Dr Anna Fogli and her clinical staff with a health history that is honest, accurate, reliable and complete.
The Patient understands that withholding any medical information could be detrimental to his or her health and safety and may result in cancellation of the procedure with no refund. The Patient agrees that if any change occurs in his or her medical history or status to inform Dr Anna Fogli without delay and to keep Dr Anna Fogli informed.
It is the Patient’s responsibility to ensure that he or she provides us with all relevant medical details before each treatment. Dr Anna Fogli will not be responsible for any damage that occurs as a result of the Patient’s failure to disclose such details. The Patient agrees to comply with all instructions and/or recommendations given to them by, or on behalf of Dr Anna Fogli, regarding the before and after care of a treated area.
The Patient should understand that all Aesthetic procedures on patients under the age of 18 years should be exceptional and only undertaken after a full assessment of the risks and benefits, including the health and psychosocial consequences. It is highly recommended that the Patient include their parents or guardians in the consent process. However, Dr Anna Fogli might refuse the treatment to a Patient under the age of 18.
GENERAL OBLIGATIONS
Dr Anna Fogli reserves the right to alter the Patient’s appointment date and/or time and/or outpatient appointments although such changes will be avoided wherever possible. The Patient agrees that no consequential loss will be payable for the short notice cancellation on any procedure/ appointment.
Moreover, we reserve the right to cancel or postpone your procedure in the interest of the Patient safety and welfare.
The Patient agrees that in signing this set of Terms and Conditions and the Medical History Form that he/she has understood the terms and has been given an opportunity to seek explanation.
Dr Anna Fogli will not be liable in contract, tort or in any other way for any economic loss (including, without limitation, loss of profit), or for any other special, indirect or consequential loss or damage arising out of, or in connection with, its provision of any goods and/or services to the Patient.
TREATMENT SUITABILITY
Before any procedure you will always have a consultation with Dr. Anna Fogli to assess whether the treatment is suitable for you, and whether there are possible alternative treatments. You will be informed if the procedure is likely to be successful and if no, the reasons why. Dr Anna Fogli performes only the treatments that are in in your best interest.
Please note it might not be possible for you to have treatment on the day if you:
Have an important event soon after your treatment due to possible bruising and swelling
Have an active cold sore or other skin condition in the treated area
Have your wedding within 6 weeks from your consultation
Have any underlying illnesses or previous surgeries in the area that weren’t mentioned beforehand
Have had previous or incorrectly placed filler that needs to be removed first to guarantee optimal results.
Had previous permanent fillers.
PRICES
The prices are listed on this website and brochure. Prices are subject to variation without prior notice. Therefore the Patient should understand that the prices are subjected to confirmation at the time of consultation.
TREATMENT EXPECTATIONS
The practice of medicine and surgery is not an exact science and therefore no guarantee can be given as to the precise results of any treatment undertaken. Every effort is made to ensure you have the best possible outcome. However, as with all medical procedures, the results may vary. The results differ from person to person and depend on multiple factors, some of which cannot always be predicted. Dr Anna Fogli will use what is considered best practice and up-to-date techniques to achieve best outcome. Though, please note there can be no guarantees as to the final outcome and your expectations and the predicted realistic outcome may be different.
Dr Anna Fogli will not provide refunds on treatments that have been provided in good faith with all appropriate consents.
We attempt to treat all of our Patients properly, compassionately and fairly. If, however, in the unlikely event that you have an issue with any mater in relation to your treatment, you are entitled to make a complaint and we will be happy to provide you with our complaints policy, which is also available on our website. However we may, at our discretion honor, refunds on treatments if the patient has had an adverse reaction to treatment.
COMPLAINTS
The complaints procedure is available on request. If you have a complaint regarding any aspect of your treatment, we recommend that you discuss it with Dr Anna Fogli. We will acknowledge all written complaints
If the Patient fails to attend a follow-up appointment or follow advice and guidance given, or where the results of the treatment originally provided have been affected by changes in lifestyle, illness or the natural ageing process, Dr Anna Fogli cannot commit to providing continuing procedures at special rates.
CONFIDENTIALITY
Dr Anna Fogli and the Patient agrees that all matters relating to the Patient’s treatment will be kept as confidential save where Dr Anna Fogli is required to disclose such material to relevant members of medical staff and/or relevant government authorities be they regulatory or otherwise.
The Patient confirms his or her consent to the disclosure of personal information by Dr Anna Fogli to Surgeons, Doctors and Nurses and other medical staff for the purpose of discussing Patient’s treatment.
Before and after the procedure photographs will be taken. They will remain part of your medical file.
INTELLECTUAL PROPERTY
Dr. Anna Fogli and the website www.drannafogli.com are the owners or licensees of copyright in the Images. Copyright in all Images remains with Dr Anna Fogli, this website or its licensors. All rights not expressly granted in this Image License are reserved by Dr Anna Fogli, www.drannafogli.com and its licensors.
